5. Records we hold
Unless the law gives you a right to them in another way, the records below are available only through a request under PAIA. They are kept in electronic form unless stated, for as long as the law or our retention rules require.
- Business records: the business's registrations, agreements with service providers, and correspondence.
- Financial and tax records: invoices, payment and refund records, bank statements, accounting records and tax returns, kept for at least 5 years.
- Waitlist records: business email addresses and the time each entry was made, and, in a separate table, salted hashes of the IP addresses used to limit abuse.
- Correspondence: emails and messages sent to us, and our replies.
- Customer records: the names, contact details and invoices of our customers, kept for 5 years as the South African Revenue Service requires.
- Security and audit records: sign-in records for our own systems where they exist, and the rate-limit records for the waitlist form.
- Our policies: the published legal pages, and earlier versions of them.
6. Personal information
This section sets out what section 51 of PAIA asks for about personal information:
- Why: to tell people when RHEVO becomes available, to invoice our customers, to answer questions, to keep the site secure, and to meet our legal duties.
- Waitlist: the business email address, the salted IP hash and the time of the request.
- People who contact us: name, email address and message.
- Customers: names, contact details and invoices.
- Who receives it: our service providers for hosting and the waitlist database, and the authorities where the law requires it.
- Outside South Africa: our hosting provider, which may process the site and the waitlist in its data centres in other countries, only where section 72 of POPIA allows it.
- Security: encrypted connections, a waitlist database only the owner can reach, salted hashing of IP addresses, and our hosting provider's protection against bots and abuse.
The Privacy policy sets this out in full, with how long each record is kept.
7. How to make a request
Use Form 2 of the PAIA Regulations, which you can get from the Regulator's website or from us, and send it to the information officer at [email protected] or by post to Morningside, Johannesburg, 2196. Please include:
- enough detail for us to identify you and the records you want;
- how you would like to receive them, for example by email or as a printed copy;
- your email or postal address;
- the right you want to exercise or protect, and why you need the records for it;
- if you ask on someone else's behalf, proof that you may do so.
If you cannot read or write, or have a disability that stops you using the form, you may make your request by phone or in person, and we help you complete it.
8. Fees
- Request fee: currently R140, as set in the PAIA Regulations. There is no request fee when you ask for your own personal information.
- Access fee: if we grant access, the Regulations also set fees for copies and for the time spent searching for and preparing the records, for example R2 a printed page and R145 for each hour after the first.
- Deposit: if the search will take more than 6 hours, we may ask for a deposit of one third of the access fee first.
- We may withhold the records until the fees are paid.
- Under POPIA, asking whether we hold personal information about you is free.
9. How we decide
- We decide within 30 days of receiving a complete request, and tell you in writing.
- Where PAIA allows, we may extend this once, by up to 30 more days, and tell you why.
- If the records hold information about someone else, we may first have to tell that person and give them a chance to answer, as PAIA requires.
- If we refuse, we give our reasons, the sections of PAIA we rely on, and what you can do next.
- If a record cannot be found or does not exist, we tell you so by affidavit, with the steps we took to look for it.
10. Grounds for refusal
PAIA requires or allows us to refuse access, in whole or in part, to protect:
- the personal information of someone else;
- the commercial information of someone else, or of NEURQ Labs;
- information given to us in confidence;
- the safety of a person, or the security of property;
- records that are privileged in legal proceedings;
- research information whose release would seriously harm the researcher.
11. If a request is refused
If a request to us is refused or not answered, you may complain to the Information Regulator on its Form 5, sent to [email protected], or apply to a court.
